Terms of Service

1. Acceptance of Terms

By accessing or using the Regi's Scale platform ("Service"), operated by Regi's Scale ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Regi's Scale is a clinical intelligence platform for home care systems. It provides evidence-based patient assessment tools using the Regis Scale methodology, including clinical scoring, risk classification, report generation, evolution tracking, and audit trail capabilities.

The Service is intended for use by licensed healthcare professionals and authorized personnel within healthcare organizations.

3. User Accounts

  • You must provide accurate, complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your credentials.
  • You must notify us immediately of any unauthorized use of your account.
  • One account per individual. Sharing accounts is prohibited.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the Service for commercial purposes other than those expressly authorized;
  • Attempt to gain unauthorized access to any part of the Service;
  • Transmit viruses, malware, or any harmful code;
  • Use the Service to store or transmit data in violation of applicable laws;
  • Reverse engineer, decompile, or disassemble any part of the Service;
  • Use automated systems (bots, scrapers) to access the Service.

5. Clinical Disclaimer

The Regi's Scale platform is a clinical decision-support tool, not a substitute for professional medical judgment. All assessments, scores, and recommendations generated by the platform should be reviewed and validated by qualified healthcare professionals before clinical decisions are made. The Company is not liable for clinical outcomes resulting from the use of the platform.

6. Data and Privacy

Our handling of personal data and protected health information is governed by our Privacy Policy. By using the Service, you acknowledge and agree to our data practices as described therein.

You are responsible for ensuring that your use of the Service complies with all applicable data protection laws (LGPD, HIPAA, GDPR) in your jurisdiction.

7. Intellectual Property

The Service, including the Regis Scale methodology, software, design, logos, and documentation, is the exclusive property of the Company. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

Data you input into the platform remains your property. You grant us a limited license to process and store such data solely to provide the Service.

8. Subscription and Payment

  • Free trial period: 30 days with full feature access.
  • After the trial, continued use requires an active subscription.
  • Prices are subject to change with 30 days' prior notice.
  • Subscriptions renew automatically unless cancelled.
  • Refunds are governed by applicable consumer protection laws.

9. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for disruptions caused by factors beyond our control.

10. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or violation of any applicable law.

12. Termination

Either party may terminate the agreement at any time. Upon termination:

  • Your access to the Service will be deactivated;
  • You may request export of your data within 30 days;
  • After 90 days, your data will be permanently deleted.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the Federative Republic of Brazil. For users in the European Union, mandatory EU consumer protection laws apply. For users in the United States, these Terms are additionally subject to applicable federal and state laws.

15. Dispute Resolution

Any disputes shall first be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the courts of Recife, Pernambuco, Brazil, with the exception of jurisdictions that require local dispute resolution.
